The Council for the Judiciary supports promotion of the judge of Supreme Court of the Department of Administrative Cases, Janis Neimanis, to position of judge in the Constitutional Court. The Council for the Judiciary adopted the decision in sitting of 28 November.
Janis Neimanis was nominated by the Plenary Session of the Supreme Court, but before the parliamentary vote, the candidate had to receive the approval of the Council for the Judiciary.
Janis Neimanis informed the Council for the Judiciary about his motivation to stand as a candidate for position of judge in the Constitutional Court, pointing out that he considers it a public service, where he has been holding various positions since 1995. In his response to Aldis Lavins, the President of the Constitutional Court, question about how legislative framework of the Constitutional Court could be improved, Janis Neimanis highlighted two proposals. First of all, the Constitutional Court could provide more substantiated explanation for refusal to accept the application, if the application is submitted by general jurisdiction or the administrative courts, similarly, as to practice of the European Court of Justice. Secondly, there should be possibility of judges of courts of general jurisdiction and administrative courts to take part in traineeship in Legal Bureau of the Constitutional Court, thus expanding their scope of expertise and gaining additional education.
The Council for the Judiciary reviewed an issue in the sitting of 28 November.
