The request to submit an application to the Constitutional Court about problems in calculating the retirement pension for judges has been referred to the Council for the Judiciary by a judge of Riga Regional Court, whose retirement pension is calculated without including the time period worked as a lawyer, as it is less than ten years. The Ministry of Justice, after conducting a study on this issue on behalf of the Council for the Judiciary, has concluded that the problem identified by the judge exists, and therefore the Ministry proposes to move forward amendments to the Law on Judges' Retirement Pensions thus deleting the reference of the ten-year term.

The Council for the Judiciary has decided not to apply to the Constitutional Court at the moment, but to support the Ministry of Justice's initiative to amend the Law on Judges' Retirement Pensions.
