At the meeting on 21 October, the Council for the Judiciary examined the issue of the regulation of disciplinary liability of judges and conceptually decided that the immunity of judges in cases of administrative offenses should be waived. Members of the Council for the Judiciary, representatives of the Judicial Ethics Commission, the Judicial Disciplinary Committee, the Disciplinary Court and the representatives of judges’ associations took part in the discussion.
The Council for the Judiciary ruled that a judge shall be subject to administrative penalty, shall be subject to administrative detention and shall be subject to forced conveyance.
The Council for the Judiciary also considers that the imposition of administrative penalty does not relieve the judge from evaluation of ethicalness of his/her conduct under disciplinary procedures.
In further discussions and when drafting amendments to the law On Judicial Power, to the Judicial Disciplinary Liability Law and to the Law on Administrative Liability, the Ministry of Justice is called to take into account the opinions and suggestions of the Council for the Judiciary.
